If you do not agree to these Terms and Conditions (the "Terms"), please do not register for or use if the Geomium site or use any of our services.

These Terms govern your use of and access to the Geomium site at gemium.com, mobile phone applications and other services provided by Geomium Limited to individual users (the "Geomium Services") whether as a visitor or a registered user, and your relationship with Geomium Limited ("Geomium", "we" or "us"). Please read them carefully as they affect your rights and liabilities under the law. These Terms operate in addition to our privacy policy.

By using the Geomium Services you signify that you agree to the Terms that appear below and you are forming a contract with us. These Terms do not affect your statutory rights.

1. Use of the Geomium Services

Access to the Geomium Services is free of charge for your personal use subject to these Terms.

It is currently free for you to download the Geomium mobile phone applications and to use any other services provided by us to individual users.

If, in future, we decide to charge for any of the Geomium Services, we will inform you before you subscribe to any such Geomium Services and make sure that the amount of any charges is clear to you. responsible for complying with any terms and conditions, such as age restrictions, on any website that you register with via the Geomium Services. 2.  Registration and security

2.1 You agree to always give us accurate and up to date information about yourself if you register with us and let us know immediately if any of this information changes.

2.2 Upon registration, you may be asked to create a unique password. You must ensure that your password is kept private at all times and you must not share it with anyone.

2.3 You are responsible for all use of the Geomium Services using your password and for preventing unauthorised use of your password. If you believe there has been unauthorised use of your password or if you know or suspect that someone else knows your password you must tell us immediately using the contact details above.

2.4 We may ask you to change your password. If you do not do so when requested, you may not be able to access all or certain areas of the Geomium Services or we may suspend or cancel your account.

3. Amendments

We may occasionally update these Terms for legal or regulatory reasons or to ensure proper operation of the Geomium Services. As and when there are any changes, we will notify you by email or via a suitable announcement on the Geomium Services. Once we have given you notice, the changes will take effect. If you do not agree with the change in the Terms, please do not continue to use the Geomum Services because if you do, your use will indicate your agreement to be bound by the new Terms.

4. Content of the Geomium Services

4.1 Although we will use reasonable skill and care in providing the Geomium Services we cannot guarantee the accuracy, completeness or quality of their content. If we become aware that any information is inaccurate or out of date we will remove it from the Geomium Services or take other appropriate action.

4.2 The content of the Geomium Services are for your general information and use only and are not intended to address your particular requirements. They do not constitute any form of advice, recommendation or arrangement by us and are not intended to be relied upon by you in making (or in deciding not to make) any specific decision and any arrangements you make with a third party accessed via the Geomium Services is at your own risk.

5. Links to other websites and services

The Geomium Services may contain links to other websites or materials which are not under our control. These links are provided for your convenience only and we make no guarantees in relation to the contents or security of those websites.

6. Advertising and Sponsorship

The Geomium Services may contain advertising and sponsorship. These advertisers and sponsors are responsible for ensuring that their material on the Geomum Services complies with relevant law and codes. We will not be responsible to you for any error or inaccuracy in advertising and sponsorship material.

7. Access to the Geomium Services

7.1 We make no promise that your access to the Geomium Services will be uninterrupted or error free.

7.2 Access to the Geomium Services may be occasionally restricted or reduced to all or some users, including but not limited to restricting your access to allow for repairs, maintenance or the introduction of new facilities or services.

7.3 We may, at our discretion, vary, alter or discontinue all or any aspect of the content of the Geomium Services.

7.5 Because of the nature of the Internet, the Geomium Services are provided on an "as is" and "as available" basis. We are not responsible to you if we are unable to provide our Geomium Services for any reason beyond our control.

8. Your conduct on Geomium Services

8.1 You must not use the Geomium Services in a way which causes or is likely to cause the Geomium Services to be interrupted, damaged or impaired in any way.

8.2 You agree not to use the Geomium Services to conduct, in our reasonable opinion, inappropriate communications and you agree to use the Geomium Services sensibly and fairly. This includes if, in our reasonable opinion, you send offensive or illegal communications.

8.3 You must let us know immediately if anyone brings or threatens to bring a claim or legal proceedings against you relating to your use of the Geomium Services. You agree to immediately stop the act that is the subject of the claim or legal proceeding and, if we ask you to, you will let us know the details of the claim or the proceedings in writing.

9. Our responsibility to each other

9.1 If we are in breach of these Terms, we will only be responsible for any direct losses that you suffer as a result to the extent that they are a foreseeable consequence to both you and us at the time you first use or register for the Geomium Services, subject to a limit of £1,000. Our liability shall not in any event include business losses of any nature whatsoever.

9.2 You agree to be responsible for all damage suffered by us arising out of any breach by you of these Terms, to the extent that such damage is a foreseeable consequence to both you and us at the time you first use or register for Geomium Services.

9.3 Nothing in these Terms shall operate to exclude or limit our liability for fraud, death or personal injury caused by negligence or for any liability which cannot be limited or excluded by any relevant law.

10. Copyright / Trademarks

10.1 All rights in the designs and information in the Geomium Services or distributed by Geomium Services via email, fax, mobile phone, handheld computer or other device are protected by copyright, trade marks, database right and other intellectual property rights, which are owned by Geomum Limited or its licensors. You are not allowed to copy, reproduce, modify, distribute, republish, display, post, transmit or use for commercial purposes any part of the Geomium Services without our written permission.

11. Suspension or cancellation

11.1 You can cancel your registration at any time by informing us in writing at cancel@geomium.com. If you do so, you will no longer be able to use the Geomium Services or those features of the Geomium Services that require registration.

11.2 We may immediately suspend or cancel your access to and/or registration at our reasonable discretion if you breach any of your obligations under these Terms.

11.3 The suspension or cancellation of your registration and your right to use the Geomium Services shall not affect either party’s statutory rights or liabilities.

12. General

12.1 These Terms are subject to English law. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take out proceedings you must do so in England or Wales.

12.2 We would like you to be able to access the Geomium Services wherever you are and we have no reason to believe that the materials on the Geomium Services are inappropriate or unavailable for use in locations outside the United Kingdom. However, if you are unsure about whether the contents of the Geomium Services are illegal or unlawful where you live, please seek advice before accessing the Geomium Services. If you choose to access the Geomium Services from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.

12.3 You may not transfer any of your rights under these Terms to any other person. We may transfer our rights under these Terms to another business where we reasonably believe your rights will not be affected.

12.4 If you breach these Terms and we choose to ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms.
